The Primo Studio – Real Estate Media Services

By booking, ordering, purchasing, or using services provided by The Primo Studio, the person or business placing the order (“Client”) agrees to the following Terms & Conditions.

1. Appointment Time & Confirmation

• The appointment time selected during online booking is a preferred/requested time and is not guaranteed.

• The Primo Studio will make every reasonable effort to accommodate the Client’s preferred time.

• The final appointment time is subject to photographer availability and must be confirmed by the photographer/The Primo Studio.

• Scheduling may occasionally need to be adjusted because of travel time, previous appointments, weather, property access, or other circumstances.

2. Property Must Be Photo-Ready

• The property must be clean, staged, accessible, and completely photo-ready before the photographer arrives.

• This includes removing unnecessary clutter, personal items, trash, toiletries, vehicles where appropriate, and securing pets.

• Lights should be operational and areas that are to be photographed must be accessible.

• The photographer is not responsible for cleaning, staging, moving furniture, making beds, organizing rooms, or preparing the property.

• The property will generally be photographed as it appears when the photographer arrives.

• If the property is not ready and significant delays occur, the photographer may photograph the property as-is, shorten the session, or require the appointment to be rescheduled.

3. Property Access

• The Client is responsible for ensuring access to the property at the confirmed appointment time.

• Lockbox codes, gate instructions, building access, parking instructions, contact information, and other necessary access details should be provided before the appointment.

• The Client is responsible for obtaining permission from the property owner, tenant, property manager, HOA, building management, or any other necessary party before the shoot.

• If the photographer cannot access the property or the shoot cannot proceed because access was not properly arranged, it may be treated as a same-day cancellation/rescheduling.

4. Cancellation & Rescheduling

• Cancellations or rescheduling should be requested at least one day before the scheduled appointment.

• A $75 fee applies to any same-day cancellation or same-day rescheduling.

• Failure to provide property access at the scheduled appointment may also be treated as a same-day cancellation.

• If The Primo Studio must reschedule because of circumstances within its control, no cancellation or rescheduling fee will be charged.

• Any applicable refund will be handled in accordance with our separate Refund Policy.

5. Drone Photography & Video

• Drone photography and video are subject to FAA regulations, airspace restrictions, local regulations, temporary flight restrictions, property restrictions, weather conditions, visibility, safety conditions, and required authorizations.

• Purchasing a package containing drone media does not guarantee that a drone can legally or safely be flown at every property.

• The remote pilot/photographer has final authority to determine whether a drone operation can be safely and legally performed.

• Drone services may be modified, postponed, substituted, or rescheduled when flight conditions or regulations prevent safe and legal operation.

6. Weather Conditions

• Exterior photography, drone operations, twilight photography, and other outdoor services depend on weather and environmental conditions.

• Rain, thunderstorms, strong winds, poor visibility, severe weather, unsafe conditions, or other circumstances may require modification or rescheduling of affected services.

• The Primo Studio is not responsible for naturally occurring conditions including cloudy skies, seasonal landscaping, construction, traffic, neighboring properties, water conditions, or other environmental elements beyond our reasonable control.

7. Media Delivery

Completed media will normally be delivered electronically through an online gallery, download link, Matterport link, or other digital delivery method.

Standard turnaround times:

• HDR Photography – within 24 hours

• Floor Plans – within 24 hours

• Matterport 3D Scans – within 24 hours

• Videos – approximately 3–5 business days

• Social Media Reels – approximately 3–5 business days

Turnaround begins after completion of the scheduled shoot.

Delivery times may be extended when additional revisions, custom editing, unusually large projects, technical problems, platform processing delays, severe weather, holidays, or circumstances outside the reasonable control of The Primo Studio affect production.

Different components of the same order may be delivered separately.

8. Editing & Creative Style

• Delivered photographs and videos will be professionally edited according to The Primo Studio’s standard style and professional judgment.

• The Primo Studio retains reasonable creative discretion regarding image selection, exposure, color, cropping, composition, perspective correction, video sequencing, music, transitions, and overall presentation.

• Minor differences in color, brightness, composition, sky appearance, or editing style are not considered defects.

9. RAW & Unedited Files

Unless specifically agreed to in writing:

• RAW photographs are not included.

• RAW video footage is not included.

• Unedited photographs or videos are not included.

• Editing project files are not included.

The Client is purchasing the finished media described in the selected package.

10. Revisions & Correction Requests

• Clients should review delivered media promptly and notify The Primo Studio of any reasonable correction requests.

• Corrections resulting from editing mistakes will be addressed when reasonably possible.

• Extensive revisions, alternative video edits, music changes, removal of objects, virtual staging, significant retouching, or requests outside the original scope of the purchased service may require an additional fee.

• A reshoot requested because the property was not properly prepared, staged, accessible, or ready during the original appointment may require a new booking or additional charge.

11. Copyright & Ownership

Unless otherwise agreed in writing, all photographs, video footage, drone footage, edited videos, and other original creative media produced by The Primo Studio remain copyrighted property of The Primo Studio.

Payment for services provides the Client with a license to use the delivered media as described below. It does not transfer copyright ownership to the Client.

12. Client Usage Rights

After full payment, the Client may use delivered media for marketing and advertising the photographed property, including:

• MLS listings

• Realtor and brokerage websites

• Property listing websites

• Social media

• Digital advertisements

• Email marketing

• Property brochures

• Flyers

• Realtor promotional materials

The Client may provide media to their brokerage, MLS, listing portals, or vendors when reasonably necessary to market the photographed property.

The Client may also use delivered media to promote their own real estate services, subject to these Terms.

13. Third-Party Use

The Client may not sell, license, transfer, or provide the media to an unrelated third party for that party’s independent commercial advertising or promotional use without permission from The Primo Studio.

Examples may include:

• Builders

• Developers

• Architects

• Interior designers

• Contractors

• Staging companies

• Hotels

• Property management companies

• Publications

• Other agents or businesses

Such parties may contact The Primo Studio separately regarding commercial licensing.

14. Portfolio & Promotional Use

Unless confidentiality has been requested and agreed to in writing before the shoot, The Primo Studio may use selected photographs or video clips from completed projects for:

• The Primo Studio website

• Portfolio

• Social media

• Demonstration reels

• Advertising

• Promotional materials

Clients requiring confidentiality should notify The Primo Studio before the photography appointment.

15. Media Storage

• Clients are responsible for downloading and securely backing up their delivered media.

• Online galleries and download links should not be considered permanent storage.

• The Primo Studio does not guarantee indefinite storage or future availability of completed media.

• If archived media remains available, retrieval or re-uploading may be subject to an additional fee.

16. Floor Plans & Measurements

Floor plans and measurements provided as part of real estate media services are intended primarily for marketing and informational purposes.

Measurements may be approximate and should not be relied upon for construction, renovation, appraisal, legal boundaries, engineering, architectural, or other purposes requiring certified measurements.

Clients and prospective buyers should independently verify measurements when accuracy is material to their decision.

17. Matterport & Third-Party Platforms

Matterport tours, hosting, music libraries, online galleries, cloud services, MLS systems, social media platforms, and other third-party services may be subject to their own terms, technical limitations, availability, or platform changes.

The Primo Studio is not responsible for outages, restrictions, content removals, platform changes, or failures caused solely by third-party providers.

18. Property Representation

The Primo Studio provides professional media services and does not independently verify property characteristics, square footage, amenities, property boundaries, legal descriptions, listing information, or representations supplied by the Client.

The Client remains responsible for ensuring that their listing and advertising comply with applicable MLS rules, real estate regulations, advertising requirements, and other applicable laws.

19. Client Authorization

By ordering services, the Client represents that they have the necessary authority or permission to:

• Request photography or video of the property;

• Allow the photographer to enter areas made available for the shoot;

• Authorize drone operations from the property when applicable; and

• Use the delivered media for the purposes described in these Terms.

The Primo Studio is not responsible for disputes arising because the Client failed to obtain necessary property-owner, tenant, building, HOA, or other permissions.

20. Safety

The photographer may refuse to enter or remain in any area considered unsafe.

This may include unsafe structures, aggressive or unsecured animals, hazardous materials, threatening individuals, active construction hazards, severe weather, or other conditions that could reasonably create a risk to people or equipment.

21. Payment

Payment is due according to the amount and payment terms displayed during booking unless otherwise agreed in writing.

Additional services, upgrades, additional editing, reshoots, or work requested outside the original package may be charged separately.

Delivery of media may be withheld until outstanding balances associated with the order have been paid.

22. Refunds

Refund eligibility is governed by The Primo Studio’s separate Refund Policy.

Completed photography, video, editing, digital media, and other services that have already been substantially performed generally cannot be returned in the same manner as physical products.

Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable law.

23. Limitation of Liability

To the fullest extent permitted by applicable law, The Primo Studio will not be liable for indirect, incidental, consequential, special, or lost-profit damages arising from the services.

If media is lost, damaged, corrupted, or cannot be delivered because of equipment failure, file corruption, technical malfunction, or another unforeseen event, The Primo Studio will make reasonable efforts to resolve the issue, which may include a reshoot, replacement service, refund, or credit as appropriate.

To the fullest extent permitted by law, The Primo Studio’s total liability arising from a particular order will not exceed the amount actually paid by the Client for the affected service.

Nothing in this section excludes liability that cannot legally be excluded or limited.

24. Events Beyond Reasonable Control

The Primo Studio will not be responsible for delays or inability to perform caused by circumstances reasonably outside its control, including severe weather, natural disasters, road closures, government restrictions, emergencies, power or internet outages, equipment failure despite reasonable precautions, illness, airspace restrictions, or other similar events.

Where reasonably possible, The Primo Studio will work with the Client to reschedule or otherwise resolve the affected service.

25. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute relating to services provided by The Primo Studio will be subject to applicable Florida law and, where legally permissible, brought in an appropriate court located in the county where The Primo Studio maintains its principal place of business.

26. Severability

If any portion of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

27. Entire Agreement

These Terms & Conditions, together with the Client’s order, selected package, Refund Policy, Privacy Policy, and any written modifications agreed upon by The Primo Studio, constitute the agreement governing the booked services.

28. Acceptance of Terms

By checking the acceptance box and placing an order, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.

The Primo Studio reserves the right to update these Terms & Conditions from time to time. The version accepted at the time of booking will govern that order.
